1. WHO WE ARE

This website is operated by LuxeShade ("we", "us", "our"), Vasavägen, 64610 Närpes, Finland. You can reach us at info@luxeshadeeyewear.com.

By visiting or purchasing from luxeshadeeyewear.com, you agree to these Terms of Service and to our Privacy Policy, our Shipping Policy and our Return and Refund Policy, which form part of these Terms. If you do not agree to them, please do not use this website.

2. ELIGIBILITY

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order with us.

3. OUR PRODUCTS

We do our best to display our products accurately. Colours and appearance may differ slightly from how they appear on your screen, depending on your device and its settings.

Product descriptions, prices and availability may change at any time without notice. We may discontinue a product or limit the quantity available to any customer or region.

4. ORDERS

When you place an order you are making an offer to buy. A contract is formed only when we confirm that your order has been accepted and dispatched. We may decline an order, for example if the product is unavailable, if there is an error in the price or description, or if we suspect fraud. If we decline your order, we refund any payment in full.

Please check your order carefully before submitting it. Contact us immediately at info@luxeshadeeyewear.com if you need to change or cancel an order, and we will help if it has not yet been dispatched.

5. PRICES AND PAYMENT

All prices are shown in euros. LuxeShade is not currently registered for VAT, as our turnover is below the Finnish registration threshold, so no VAT is added to our prices.

Shipping costs are shown separately at checkout before you pay. Orders shipped outside the European Union may be subject to customs duties or import taxes set by the destination country. Where these can be calculated in advance, they are shown at checkout.

Payment is processed by our payment providers. We do not store your card details.

6. SHIPPING AND DELIVERY

Our products are shipped from our supplier in Asia. Estimated delivery times are set out in our Shipping Policy. All delivery times are estimates and are not guaranteed.

We are not liable for delays caused by carriers, customs processing or other events outside our reasonable control. If your order has not arrived within the time stated in our Shipping Policy, contact us and we will help resolve it.

7. YOUR RIGHT TO CANCEL

If you are a consumer in the European Union, you have the right to cancel your purchase within 14 days of receiving it, without giving a reason. The details of how to cancel, and how refunds are handled, are set out in our Return and Refund Policy.

Nothing in these Terms limits your statutory rights as a consumer under Finnish or EU law.

8. FAULTY OR INCORRECT ITEMS

If an item arrives damaged, faulty or is not what you ordered, contact us within 14 days of delivery and we will replace it or refund you in full, including shipping costs. Your statutory rights under consumer protection law apply in addition to this.

9. INTELLECTUAL PROPERTY

The content of this website, including text, images, graphics, logos and product photography, is owned by LuxeShade or used with permission, and is protected by copyright and trademark law. You may view and use the site for your own personal, non-commercial purposes. You may not copy, republish, distribute or commercially exploit any part of it without our written consent.

10. ACCEPTABLE USE

You agree not to use this website unlawfully, to interfere with its operation or security, to attempt unauthorised access to any part of it, to transmit malicious code, or to collect data about other users. We may suspend or refuse service to anyone who does.

11. THIRD-PARTY SERVICES AND LINKS

This store is powered by Shopify, and we use third-party services for payments, shipping, email and analytics. Any purchase you make is a contract between you and LuxeShade, not with Shopify or any other provider.

This site may link to third-party websites that we do not control. We are not responsible for their content, products or privacy practices. Review their terms before using them.

12. PRIVACY

We process personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation. Please read the Privacy Policy to understand what we collect and why.

13. REVIEWS AND SUBMISSIONS

If you submit a review, comment, photo or suggestion to us, you confirm it is your own and that it does not infringe anyone else's rights. You grant us permission to publish and use it in connection with our store. We may remove content that is unlawful, offensive or misleading, but we are not obliged to monitor submissions.

14. ERRORS

Occasionally this site may contain typographical errors or inaccuracies relating to descriptions, prices, shipping charges or availability. We reserve the right to correct such errors and to cancel affected orders, refunding you in full, including after an order has been submitted.

15. LIABILITY

We are liable for damage caused by our own negligence or breach of contract to the extent required by Finnish law. We are not liable for indirect or consequential losses, such as loss of profit, where the law permits us to exclude them.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under mandatory Finnish or EU consumer law.

16. COMPLAINTS AND DISPUTE RESOLUTION

If you are unhappy with your order, contact us first at info@luxeshadeeyewear.com and we will do our best to resolve it.

If we cannot reach an agreement, consumers resident in the EU may refer the matter to the Finnish Consumer Disputes Board (kuluttajariitalautakunta, kuluttajariita.fi) or use the European Commission's online dispute resolution platform.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. Please check this page periodically for changes.

18. GOVERNING LAW

These Terms and any purchase made through this website are governed by Finnish law. Disputes are subject to the jurisdiction of the Finnish courts. If you are a consumer, you may also bring proceedings in the courts of the EU country where you live.
